Martin Saban-Smith LMPA takes the privacy and security of his clients details and images very seriously. We will never forward or sell any clients details to any company or person for any purpose whatsoever unless in conjunction with a Joint Promotion (see below for details).
All client, supplier and other records kept by Martin Saban-Smith LMPA are done so on a computer system in line with the Data Protection Act. All systems are protected by regularly updated firewall and anti-virus programs. Any piece of software that holds customer information is password protected to prevent the unlikely event of a third party enterting the system.
PORTRAITS: A portrait session is a photography session either in the studio or on location where one or more people are photographed for a domestic purpose and not related in any way to a business. Portrait sessions are available to book at the studio between 10am and 4pm Tuesday - Saturday at the standard rate. For other times and locations, a separate quote will be required.
From 1st March 2008 a £25.00 booking fee will be taken at the time a photography session is booked. This will be deducted from your final print order.
COMMERCIAL: Commercial commissions are quoted for individually depending on the clients requirements. Please contact us for a quote.
TIME LAPSE/PANORAMIC: These commissions are quoted for individually depending on the clients requirements. Please contact us for a quote.
APPOINTMENTS: Whilst you can visit the studio at any time, it is advisable to make an appointment. These can be made either via the contact page or by phone on 01420 542020.
VOUCHERS: Complimentary vouchers can be used towards re-print orders placed either over the phone, email or in person at the studio for our domestic print products only. They cannot be used to pay for or contribute towards to purchase of any other product such as mugs, keyrings etc. They cannot be used to contribute to the cost of any service fee such as sitting or other photography fees. Purchased gift vouchers can be used against any domestic service or order placed over the phone, email or in person. Voucher value is £0.001p. No change will be given. Complimentary gift vouchers are valid for 2 months after the issue date. Purchased gift vouchers are valid for 6 months from purchase date.
TELL 10: Tell 10 exists to reward clients with high resolution images from their shoot for sending 10 e-cards and/or 10 v-cards (movie cards) from this website. To ensure 'fair play', e-card content may be checked from time to time for 'gobbledegook' messages that make no sense, multiple cards sent to the same email address with the same or similar messages, multiple messages to same email address as the sender or other messages that may be deemed as unfair in the process of being awarded the hi-resolution image(s). Any message that is deemed to be unfair will be deleted from the system and the count of 'fair' messages for that client will automatically change. We reserve the right to cancel any customer's participation in the scheme if they persistantly send unfair messages. You may continue to send e-cards and v-cards free of charge even after you have completed the Tell 10 scheme.
IMAGES: All image sizes are nomial. We will provide a pleasing colour balance but the client accepts and agrees that Martin Saban-Smith LMPA cannot guarantee exact colour matching owing to the anomalous reflectance caused by a combination of certain dyes and materials especially in man made fibres and that it is sometimes impossible to record photographically the exact colour seen by the human eye.
LICENSE: Martin Saban-Smith LMPA shall be granted artistic license in relation to the poses photographed and the locations used (if any). Due to vagaries of the weather and the willingness of the subject/s, it may not be possible to capture all of the images requested by the client.
RETOUCHING: Retouching, digital manipulation and finishing is available, although for portrait sessions, the majority of the retouching work will have already taken place before the client sees the images. Additional work that is requested to be undertaken by the client will be charged at £15.00 per hour or part thereof.
PAYMENTS: All payment details are handled in the strictest confidence. When placing an order either in person, online or over the telephone it may be necessary to take details such as your name, address, telephone numbers, credit card details or any other information in order to complete the transaction. Refusal to part with any such information may result in the order not being completed. Where appropriate, an alternative payment method will be offered. All products are to be paid for in full at the time of placing the order unless we agree to a deposit or ongoing part payment scheme as described below. Please note that as of 1st January 2007, we no longer accept cheques as a form of payment.
DEPOSITS/PART PAYMENTS: If you wish to pay for your order in installments, this can be arranged for you. However, you will not receive your order until payment has been made in full. At the time of ordering, we will agree a time scale which is suitable for you to pay the balance. This can by up to a maximum of 6 months. There is a handling charge of 15% of the total order value for this service which will be added to the invoice total. A non refundable deposit of 20% of the order total is payable at the time of the agreement which will be deducted from the outstanding balance.
REFUNDS: Because of the individual nature of the products provided by Martin Saban-Smith LMPA, refunds may not be possible in respect of images already printed (on photographic paper or otherwise) or if they have been received by the client. All refund requests are dealt with on a case by case basis. No refunds are available for Downloaded/emailed images whatsoever.
COPYRIGHT: At all times, copyright of all images, text and all other presentation methods used by Martin Saban-Smith remains with him. It is contrary to the Copyright, Design and Patents Act 1988 to copy, allow to be copied photographically, electronically or by any other means any image created for you by Martin Saban-Smith LMPA. This also applies to images in all promotional material, website or otherwise. With respect to commercially taken images, copyright of the images is granted to the client with an understanding that Martin Saban-Smith LMPA can use the images for self promotion or any other use unless agreed in writing. A fee for complete hand-over of copyright materials may be negotiated.
DISPLAY: We reserve the right to use any image taken by Martin Saban-Smith (or a subcontractor) of any person, people, event, product, business, location or otherwise for his own promotional purposes. This includes manipulation of the image for the purpose of display and/or advertising in any media be it electronic, print or otherwise.
COMPLAINTS: In the event of dissatisfaction with the service provided by Martin Saban-Smith, a complaint in writing will be welcomed describing the nature of your complaint. Upon receipt of this letter, Martin Saban-Smith LMPA will respond within 7 days, and where appropriate, a detailed proposal to put the put right the complaint will be given. Where a mutually acceptable solution cannot be agreed upon, The Master Photographers Association may act as mediator. Your statutory rights will not be affected.
JOINT PROMOTIONS: In respect of promotions whereby Martin Saban-Smith LMPA and an associate company jointly promote a special offer or competition, applications/entrants or interested party's details will be exchanged for administration and promotional purposes.
Martin Saban-Smith LMPA reserves the right to change any or all of these statements without prior warning. We also reserve the right to change any prices, discontinue special offers or products and make any changes it feels fit for the benefit of the business without prior warning.
